Using Eminent Domain to Screw the Little Guy in Spring Valley, New York
Probably what will cheer you up this morning is a story about eminent domain abuse paid for by you. If so, you’re in luck, gentle reader.
Officials in Spring Valley, New York, which is about 20 miles north of Manhattan, have been seizing properties in the village’s 15-block downtown area for the past decade and flipping them to private developers. Federal community development block grants helped pay for the acquisitions.
From The Journal News:
Mercy Anim can’t bring herself to drive down Main Street, where she had cared for young children at her day-care center before being displaced by a condo complex as part of the village’s urban renewal project.
She never found a spot to reopen Little Angels. The condo builder offered her pre-manufactured trailers to care for infants to 12-year-olds. She chose to close in 2009.
“My heart was so broken,” Anim said. “I’ve never driven on the street since I closed. They took away from me the children and their parents. I want to cry. I don’t go to Spring Valley no more.”
Village leaders, two of whom are now under federal indictment for extortion and wire fraud in an unrelated matter, demolished Anim’s business and several others in 2009. What they haven’t done is pay Anim for improvements made to the property. They’ve offered $96,000. Anim’s appraiser says she should be getting north of $1 million.
In the meantime, the developers, aided further by a variety of state and local subsidies, built senior housing as well as expensive condominiums designed to meet kosher standards.

[The developers] are accused of steering the condos to ultra-Orthodox Jews and discouraging non-religious people from buying units.
The NAACP filed a complaint after people tried to buy a condo, saying they were given more expensive prices and the runaround.
The village could be liable to repay HUD up to $1 million for not reporting the sale of property to the developer, according to a HUD audit.
Former officials say everything is above board; they knew going in that the condos would go to Orthodox Jews. But that may violate federal fair-housing rules all the same. HUD is investigating.
That’s little consolation to Anim: “I had an investment in that building,” Anim said. “They put up condos to benefit certain people. I can’t believe this can happen in America. Eminent domain is not supposed to be used that way.”

Under Obama’s administration, if you meet with someone in a terrorist group and advise them to turn to nonviolent means, then that’s material assistance to terrorism.“I personally never expected anything of Obama, and wrote about it before the 2008 primaries. I thought it was smoke and mirrors. The one thing that did surprise me is his attack on civil liberties. They go well beyond anything I would have anticipated, and they don’t seem easy to explain. In many ways the worst is what you mention, Holder vs. Humanitarian Law Project. That’s an Obama initiative and it’s a very serious attack on civil liberties. He doesn’t gain anything from it – he doesn’t get any political mileage out of it. In fact, most people don’t even know about it, but what it does is extend the concept of “material assistance to terror” to speech.
The case in question was a law group that was giving legal advice to groups on the terrorist list, which in itself has no moral or legal justification; it’s an abomination. But if you look at the way it’s been used, it becomes even more abhorrent (Nelson Mandela was on it until a couple of years ago.) And the wording of the colloquy is broad enough that it could very well mean that if, say, you meet with someone in a terrorist group and advise them to turn to nonviolent means, then that’s material assistance to terrorism. I’ve met with people who are on the list and will continue to do so, and Obama wants to criminalize that, which is a plain attack on freedom of speech. I just don’t understand why he’s doing it.
The NDAA suit, of which I’m a plaintiff - it mostly codifies existing practice. While there has been some protest over the indefinite detention clause, there’s one aspect of it that I’m not entirely happy with. The only protest that’s being raised is in response to detention of American citizens, but I don’t see why we should have the right to detain anyone without trial. The provision of the NDAA that allows for this should not be tolerated. It was banned almost eight centuries ago in the Magna Carta.
It’s the same with the drone killings. There was some protest over the Anwar Al-Awlaki killing because he was an American citizen. But what about someone who isn’t an American citizen? Do we have a right to murder them if the president feels like it?”

Defense Distributed founder Cody Wilson received a letter from the State Department Office of Defense Trade Controls Compliance demanding that hetake down the online blueprints for the 3D-printable “Liberator” handgun that his group released Monday, along with nine other 3D-printable firearms components hosted on the group’s website Defcad.org, while it reviews the files for compliance with export control laws for weapons known as the International Traffic in Arms Regulations, or ITAR. By uploading the weapons files to the Internet and allowing them to be downloaded abroad, the letter implies Wilson’s high-tech gun group may have violated those export controls.
“Until the Department provides Defense Distributed with final [commodity jurisdiction] determinations, Defense Distributed should treat the above technical data as ITAR-controlled,” reads the letter, referring to a list of ten CAD files hosted on Defcad that include the 3D-printable gun, silencers, sights and other pieces. “This means that all data should be removed from public access immediately. Defense Distributed should review the remainder of the data made public on its website to determine whether any other data may be similarly controlled and proceed according to ITAR requirements.”

Too much caffeine in food has FDA worried, considering regulations
(RNN) - Caffeine is being added to foods more and more these days. But the caffeine craze has caused the Food and Drug Administration to look into the possibility regulating America’s favorite drug.
Last week, Wrigley announced it will release a new gum that will contain a half cup of coffee’s worth in each stick. The new “energy gum” is just one example of a recent trend that has seen caffeine added to everything from granola bars to jelly beans, and even water.
However, the FDA says that so many caffeinated foods could be harmful, especially to children, and the agency plans to investigate the effects.
“Our concern is about caffeine appearing in a range of new products, including ones that may be attractive and readily available to children and adolescents, without careful consideration of their cumulative impact,” said Michael R. Taylor, the deputy commissioner for foods and veterinary medicine at the FDA, in a press release.
“The proliferation of these products in the marketplace is very disturbing to us,” he added.
Taylor claimed that so much caffeine added to foods put children at risk of “excess caffeine consumption” and that the agency needs to better understand the effects, as well as determine what are safe consumption levels.
In the Q & A press release, Taylor was asked if it is possible that the FDA would set age restrictions for purchasing of caffeine.
“We have to be practical; enforcing age restrictions would be challenging,” he said. “For me, the more fundamental questions are whether it is appropriate to use foods that may be inherently attractive and accessible to children as the vehicle to deliver the stimulant caffeine and whether we should place limits on the amount of caffeine in certain products.”
The concern over caffeine comes at a time when various levels of government have been at odds with beverage manufacturers over caffeine regulation.
In April, a congressional study titled, What’s All the Buzz About? claimed that many energy drinks were misleadingly labeled as “dietary supplements” and often target-marketed toward adolescents. The drinks also contained high amounts of caffeine that were deemed harmful by the FDA.
“Caffeine toxicity is a concern, especially for children and adolescents, who are the frequently targeted demographic for energy drink companies,” the report said.
The report also cited the American Academy of Pediatrics, which said “caffeine can produce harmful health effects in adolescents, including cardiovascular problems, anxiety, insomnia, digestive problems, dehydration, and others.”
Attempts to regulate caffeine are not new. As the libertarian-leaning magazine Reason pointed out, cries to regulate the drug have been around since at least 1980 when the FDA began looking into regulating added caffeine in foods.
No new regulations were created from the FDA proceedings. However, the agency has been more vigilant in recent years when it urged caffeinated alcohol producers to remove caffeine from their drinks.
A federal ban was not issued, but several states, including Washington, Michigan, and Oklahoma, outlawed the drinks.
Taylor said that any new regulations would take much time and resources, but the FDA is ready to take the steps it deems necessary.
“We believe that some in the food industry are on a dubious, potentially dangerous path,” he said. “If necessary, and if the science indicates that it is warranted, we are prepared to go through the regulatory process to establish clear boundaries and conditions on caffeine use.”
He added “We are also prepared to consider enforcement action against individual products as appropriate.”

Assault Weapons Ban Lacks Democratic Votes to Pass Senate
A proposed ban on sales of assault weapons would be defeated in the U.S. Senate unless some lawmakers changed their current views, based on a Bloomberg review of recent lawmaker statements and interviews.
At least six of the 55 senators in the Democratic caucus have expressed skepticism or outright opposition to a ban, the review found. That means Democrats wouldn’t have a 51-vote majority to pass the measure, let alone the 60 needed to break a Republican filibuster to bring it to a floor vote.
US and Afghan presidents to meet at White House to discuss US role in Afghanistan after war formally ends in 2014
United States President Barack Obama and Afghan President Hamid Karzai are set to meet at the White House to discuss the future of the US role in Afghanistan.
Obama and Karzai have announced plans for a joint news conference on Friday afternoon.
White House officials say Obama will not announce any decisions on the next phase of troop withdrawals or whether any US forces will stay behind in Afghanistan after the war formally ends in 2014.
US commanders in Afghanistan have proposed keeping 6,000 to 15,000 US troops after 2014 to continue pursuing armed groups and training Afghan security forces.
The White House tends to favor lower troop levels than military generals.
Officials say Obama would be open to pulling all US forces out of Afghanistan at the end of 2014.
PA State Representative Introduces Legislation to Nullify Federal Gun-Grabbing
Today Pennsylvania became the 13th state in the last three weeks to introduce legislation nullifying federal encroachments of firearms ownership. State Representative Daryl Metcalfe modeled the Right to Bear Arms Protection Act (House Bill 357) after legislation recently introduced in Wyoming and Texas.
Highlights of House Bill 357 (yep, that’s 357) include:
- prohibitions against enforcement of any new federal registration, restriction or prohibition requirement for privately owned firearms, magazines and ammunition.
- the requirement that the state of Pennsylvania, including the Office of Attorney General, to intercede on behalf of Commonwealth citizens against any federal attempt to register, restrict or ban the purchase or ownership of firearms and firearms accessories which are currently legal products.
- felony charges against anyone – including federal agents who try to enforce any type of gun control restriction within state borders.
“Passage of my legislation will send the message that there will never be additional gun control, anywhere in Pennsylvania,” said Metcalfe. “Whether by White House executive orders, congressional fiat, or judicial activism, we will never allow the left to benefit from the wicked acts of murderers in order advance their senseless gun-grabbing agenda which would only succeed in replacing one of our most sacred personal liberties with the chains of government tyranny.”
